Terms of Service

1. Acceptance of Terms

By creating an account or using the BoothGator platform ("Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Description of Service

BoothGator is a SaaS platform that enables trade show exhibitors to capture qualified leads through interactive QR-code games. Features include campaign management, game configuration, lead form builder, QR code generation, lead dashboard, and CSV export.

3. Accounts & Access

• You must register with a valid company email address. Personal email domains (Gmail, Yahoo, etc.) are not accepted.
• The first user to register with a company domain becomes the account owner.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorised use of your account.

4. Subscription & Payment

• Single Event (€149): Grants access to 1 launched campaign and 1 active QR code. Valid for a single trade show event.
• Annual Unlimited (€799/year): Grants unlimited campaigns and QR codes for 12 months from the date of purchase.
• All prices are exclusive of VAT where applicable.
• Payments are processed by Stripe. By purchasing, you agree to Stripe's terms of service.
• Subscriptions do not auto-renew unless explicitly stated at checkout.
• Refunds are at our discretion. Contact support@boothgator.com within 14 days of purchase if you experience a technical issue.

5. Acceptable Use

You must not use the Service to:

• Collect personal data without a lawful basis or without informing visitors about how their data will be used.
• Spam, deceive, or mislead visitors about prizes or data usage.
• Upload malicious code, attempt to breach security, or interfere with the platform.
• Resell or sublicence the Service without written permission.
• Collect sensitive personal data (health, financial, political, etc.) through lead forms.

6. Your Responsibilities as Data Controller

When using BoothGator to collect visitor lead data, you are the data controller for that data under GDPR. This means you are responsible for:

• Having a lawful basis to collect visitor personal data.
• Informing visitors how their data will be used (e.g. via signage at your booth).
• Responding to data subject requests from your leads.
• Not retaining lead data longer than necessary.

BoothGator acts as a data processor on your behalf. Our obligations are set out in our Data Processing Agreement.

7. Intellectual Property

The BoothGator platform, branding, and all associated software are the intellectual property of BoothGator. You retain ownership of your campaign content and lead data. By using the Service, you grant us a limited licence to host and process your data as necessary to provide the Service.

8. Availability & Uptime

We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from downtime.

9. Limitation of Liability

To the maximum extent permitted by law, BoothGator's total liability for any claim arising from the Service is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

We may suspend or terminate your account if you breach these Terms. You may delete your account at any time from Settings. Upon termination, your data will be retained for 30 days before permanent deletion, unless you request immediate deletion.

11. Governing Law

These Terms are governed by the laws of France (or the jurisdiction in which BoothGator is incorporated). Disputes shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. We will give at least 30 days' notice for material changes via email. Continued use of the Service after the effective date constitutes acceptance.
